1. Publisher

PULSAR Space Intelligence SAS, 5 rue Gazan, 06130 Grasse, France. SIREN 988 868 808.
Contact: app@pulsar-si.com.

2. Purpose

These terms of use (« Terms ») govern access to and use of:

  • the aurores.pulsar-si.com website;
  • the PULSAR - Northern Lights mobile app distributed on Apple's App Store and Google's Play Store;
  • associated services, in particular push, email and webhook alerts, as well as the PULSAR Premium subscription.

Using the services implies full and unreserved acceptance of these Terms. Failing acceptance, the user must refrain from using the services.

3. Description of services

PULSAR provides aurora activity forecasts, the real-time Kp index, a light-pollution map, a travel planner and a community of observers. Data comes notably from NOAA, GFZ Potsdam, NASA satellites and proprietary models powered by artificial intelligence.

No guarantee of result can be given regarding the actual observation of northern lights. Forecasts rely on probabilistic models, and weather phenomena (cloud cover, fog) as well as local light pollution may prevent observation, regardless of the quality of the forecasts.

4. User account

Creating an account is required to access personalized features (alerts, Veille Score, community, subscription). The user undertakes to provide accurate information and to keep their credentials confidential. Any action carried out from an account is deemed to be performed by its holder.

The user may delete their account at any time from the app settings or by writing to app@pulsar-si.com.

5. PULSAR Premium subscription

5.1 Offers and pricing

  • PULSAR Premium monthly: €3.99 incl. VAT per month.
  • PULSAR Premium annual: €29.99 incl. VAT per year (equivalent to €2.49/month).
  • The prices displayed in the app prevail in case of discrepancy and may be adjusted per local currency by the Apple and Google platforms.

5.2 Free trial

A 7-day free trial period is offered to eligible new users, in accordance with Apple and Google rules. Eligibility is determined by the distribution platform. At the end of the trial, the subscription automatically switches to the chosen paid plan, unless cancelled beforehand.

5.3 Automatic renewal

The subscription is set to automatic renewal. The user's Apple or Google account is charged 24 hours before the end of the current period, for a new cycle of the same duration and at the price then in effect. Cancellation takes effect at the end of the current period; no pro-rata refund is due for the remaining period.

5.4 Cancellation

The user may cancel their subscription at any time:

  • on iOS: Settings > [Apple ID] > Subscriptions > PULSAR;
  • on Android: Play Store > Profile > Payments & subscriptions > Subscriptions > PULSAR.

Cancellation must be carried out at least 24 hours before the renewal date to avoid the next charge. Any unused trial period is forfeited when purchasing a subscription before its term.

5.5 Refunds

As payments are processed by Apple and Google, refund requests fall exclusively under their respective policies:

5.6 Right of withdrawal

In accordance with Article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for digital content whose performance has begun with the consumer's express consent, which is the case as soon as the Premium account is activated.

6. Intellectual property

The app, the website and their content (texts, images, logos, graphic design, source code, forecast models, spots database) are the exclusive property of PULSAR Space Intelligence SAS or its partners, and are protected by copyright and database rights.

Any reproduction, representation, modification or exploitation, in whole or in part, without prior written authorization is prohibited. User content (observation reports, photos, messages) remains the property of its authors, who grant PULSAR a non-exclusive, free and worldwide license to use it for the operation and promotion of the service.

7. User obligations

The user undertakes to use the services in compliance with applicable laws and to refrain from:

  • publishing unlawful, defamatory, hateful, violent or misleading content;
  • attempting to circumvent technical protections or paywall mechanisms, or to reverse-engineer the app;
  • using the data provided by the service for commercial activities without prior written agreement;
  • automatically collecting service data (scraping, bots) without authorization.

In the event of a breach, PULSAR reserves the right to suspend or terminate the account concerned without notice or refund.

8. Service availability

PULSAR uses reasonable means to ensure the availability of the service 24/7, without however guaranteeing a total absence of interruption. Maintenance operations, third-party technical incidents (NOAA, host, mobile platforms) or cases of force majeure may render the service temporarily unavailable.

9. Limitation of liability

PULSAR cannot be held liable for:

  • the absence of northern lights observation despite a favorable forecast;
  • any material or bodily harm occurring during a trip made on the basis of the forecasts (road conditions, weather, wildlife, spot access);
  • travel or investment decisions made on the basis of the information provided;
  • unavailability or malfunctions attributable to the Apple or Google platforms, or to third-party data providers.

Except in case of gross or intentional fault, PULSAR's liability is capped at the amount actually paid by the user over the last 12 months.

10. Personal data

The processing of personal data is governed by the privacy policy, which forms an integral part of these Terms.

11. Modification of the Terms

PULSAR may modify these Terms at any time to follow changes in the service or in regulations. The date of the last update appears at the top of the page. Substantial changes are notified in the app at least 30 days before they take effect. Continued use after that date constitutes acceptance.

12. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, the user is invited to contact PULSAR at app@pulsar-si.com to seek an amicable solution. Failing that, the consumer user may use the European online dispute resolution platform free of charge (ec.europa.eu/consumers/odr) or bring the matter before the competent court of their place of residence.
